WHW Surface Design Terms and Conditions
These Terms and Conditions apply to all visitors to our website www.whwsurfacedesign.com and to all clients who engage WHW Surface Design (“we”, “us”, “our”) to provide services.
By accessing this website or instructing us to carry out works, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our website or our services.
We reserve the right to amend these Terms and Conditions at any time. Any updates will be effective immediately upon being published on our website. You are advised to review them regularly.
Before Works Commence
A site visit will be carried out to discuss the scope of work. This will include, but is not limited to:
- Products to be used
- Design details
- Colour selections
- Surface preparation requirements
Following the site visit, a written quotation will be provided based on the works discussed and measurements taken. This quotation is valid for a stated period only.
Where applicable, samples will be produced and provided in line with the agreed specification.
Once samples are approved by you (verbally or in writing), a proposed start date and estimated completion date will be issued.
Minor variations may occur due to the nature of handcrafted and decorative finishes, and these are accepted as part of the process.
Client Responsibilities
- You must ensure safe and reasonable access to the site during agreed working hours.
- All areas must be clear and ready for work unless otherwise agreed.
- You are responsible for notifying us of any known issues that may affect the works (e.g. damp, unstable substrates, hidden services).
- Delays caused by restricted access, unprepared surfaces, or undisclosed site issues may affect completion dates and costs.
Payments and Deposits
- A 50% non-refundable deposit will be invoiced and must be paid in full and cleared before any works commence.
- The deposit amount may vary depending on the scale, complexity, or duration of the project. This is at our discretion and will be clearly stated on the invoice.
- The remaining balance (normally 50%) will be invoiced upon completion of our involvement in the project.
- For projects exceeding two (2) weeks, we reserve the right to issue interim invoices based on work completed to date. Any interim payments made will be deducted from the final balance.
- Failure to pay the deposit will result in works being withheld and may affect the agreed start and completion dates.
- Deposits are non-refundable, except where we are unable to provide the agreed service.
Final Payment and Late Fees
- Final invoices are payable immediately or, if agreed upon, within 14 days of the invoice date in writing.
- Late payments may incur interest at 4% per day on the outstanding balance, calculated from the due date until payment is received.
- We reserve the right to suspend further works, withhold warranties, or pursue recovery costs for unpaid invoices.
Variations and Additional Works
- Any additional or varied works requested beyond the original scope must be agreed in writing before commencement.
- Additional works will be priced separately and may affect the agreed-upon completion date.
- Written approval (email or signed document) is required before additional works proceed.
Delays and Force Majeure
We shall not be liable for delays caused by events beyond our reasonable control, including but not limited to:
- Adverse weather conditions
- Supplier delays
- Material shortages
- Illness or injury
- Acts of God or government restrictions
Completion dates are estimates only and not guaranteed.
Damage and Aftercare
- Once work is completed, responsibility for the care and protection of the finished surfaces passes to the client.
- We are not responsible for damage caused by:
- Other trades
- Clients or third parties
- Structural movement
- Water ingress
- Improper use or maintenance
- Any remedial works required due to damage will be quoted separately and must be approved in writing before proceeding.
Limitation of Liability
- Our liability is limited to the value of the works carried out.
- We are not liable for indirect, consequential, or economic losses.
- Nothing in these Terms limits liability for death or personal injury caused by negligence.
Ownership of Designs
All designs, samples, techniques, and intellectual property remain the property of WHW Surface Design unless otherwise agreed in writing.
Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
